The Legal Process – Criminal Law versus Civil Law

This workshop will address the key differences that exist between criminal and civil law in relation to child abuse, covering areas such as:

  • The role of the police and the CPS
  • The courts
  • Reporting the abuser to the police
  • The police investigation
  • The trial
  • The role of therapy and support
  • Care proceedings
  • Time limits
  • Legal Aid
  • Compensation/CICA

The seminar will also look at the possible tensions that might exist between the criminal investigation and civil proceedings with regards to the investigating the abuse of children.

Peter is the head of the Abuse department at Simpson Millar LLP.  Peter set up the department when he was Principal of Abney Garsden, which was incorporated into Simpson Millar in May 2016.

Since 1996 Peter has been Lead Solicitor in over 25 different Group Actions involving over 1000 Claimants, including the largest award achieved in the area of Child Abuse Groups of £2.3million on behalf of 165 Claimants who were abused at homes managed by Manchester City Council.

In 1997 Peter helped to set up ACAL (Association of Child Abuse Lawyers), a Claimant based organisation of compensation abuse lawyers dedicated to raising the standards of advice through training and support, of which he is now President.

Peter was recently awarded Solicitor of the Year at the Law Society Awards.
